The Concordia University “Slice of Campus Life” Photo Contest Official Rules (the “Rules”)

1. General

By entering The Concordia University “Slice of Campus Life” Photo Contest (the “Contest”), you agree and undertake to adhere to the present Rules.

2. Eligibility

This Contest is open to Concordia students, faculty and staff. Notwithstanding the foregoing, employees of Concordia’s Communications Services, members of the panel of Concordia faculty and alumni who will be judging the Contest (the “Judges”) and the persons with whom they are domiciled are not eligible to enter the Contest.

3. How to Enter Contest

An individual who enters into the Contest (the “Participant”) must submit one (1) photograph entry that that showcases life on the Concordia campus in a unique or meaningful way (the “Entry”) into the Contest between Wednesday, September 19, at 2012, at 9 a.m. Eastern Standard Time (“EST”) and Wednesday, October 10, 2012, at 11:59:59 p.m. EST (the “Entry Period”).

Participants must submit their Entry to the following website: www.concordia.ca/contest (the “Contest Website”). Participants must login to the Contest Website using their own valid Concordia Netname and Password. Participants must complete the entry form contained therein, indicate their undertaking to adhere to the present Rules and upload their Entry in .jpg format, along with a brief description explaining where they took the photograph and, where there are individuals in the image, indicating who is in the image. Incomplete Entries will be disqualified from the Contest.

Entries are limited to one (1) per Participant. Entries may not be submitted by a Participant on behalf of another person. Once an Entry has been submitted, it is considered final and may not be altered in any way or revoked by the Participant.

4. Obscene and Offensive Entries

No Entry, title or description may contain words or images that, at Concordia’s sole judgment and discretion, are obscene, pornographic, violent, cruel, mean spirited, offensive in any manner, inconsistent with the reputation of Concordia in the marketplace, or in any other way unsuitable for publication.

5. Participant Copyright

By submitting an Entry, the Participant represents and warrants that he/she is the sole owner of copyright in the Entry, has the right to provide Concordia with a license to publish the Entry, title and description thereof in any medium (including, but not limited to, in a newspaper, a magazine, on a website, including on Facebook or any other social media, etc.) (“Publish”) and that the submission does not infringe the rights of any third party.

6. Entries Containing Images of Third Parties Copyright Material and Trademarks

The Participant represents and warrants that, prior to submitting his/her Entry:

  • He/she has obtained written permission from any third party whose image is identifiable in the Entry to Publish their image;
  • The Entry has not been previously Published; and
  • He/she has obtained written permission from the owner(s) of all trademarks or copyright images identifiable in the Entry to Publish their trademark or copyright, as it appears in the Entry.

7. License to Publish Entry and for Use of Name and Photograph

Participants retain the ownership of the copyright of their Entries. However, by submitting an Entry, the Participant: (i) grants Concordia a non-exclusive, transferrable, sub-licensable, royalty-free, irrevocable and worldwide license to the Entry and to use and Publish the Entry and the title for and description thereof; and (ii) waives all moral rights in and to his/her Entry, its title and description to Concordia. The Participant understands and agrees that, as of the moment of his/her submission, his/her Entry and its title and description may be Published for worldwide viewing and for public comment, at Concordia’s sole discretion.

Concordia also reserves the right to modify the Entry and/or its title and/or description, at its sole discretion, including but not limited to by resizing the image, modifying the format, removing borders, blurring portions of the Entry containing third party copyright or trademarks, retouching the Entry and removing watermarks, advertisements, names and copyright symbols.

Furthermore, by submitting an Entry, the Participant grants Concordia the perpetual, irrevocable worldwide right to use the Participant’s name, photograph, likeness, voice, biographical information and statements for advertising and/or publicity purposes and in any media that Concordia should choose, at its sole discretion, without further compensation or authorization and releases Concordia from all claims arising out of such use.

8. Method of Choosing Winners and Criteria

After the conclusion of Entry Period, Participants who will win a prize, as listed at Section 9 hereof, (the “Winners”) will be decided by the Judges based on the following criteria:

  • Relevance to the contest – Entries must showcase life on the Concordia campus in a unique or meaningful way
  • Creativity
  • Overall Impression

9. Prizes:

The following are the prizes that will be awarded in this Contest: One (1) grand prize of $1,000, and two (2) runners-up prizes of $500 each (individually referred to as the “Prize” and collectively referred to as the “Prizes”), payable by cheque in that Prize’s Winner’s name, in Canadian dollars. Prizes are not transferable. Winners are required to pick up their Prize in person at Concordia University, University Communication Services, 1550 De Maisonneuve Blvd. West, 6th floor, Montreal, Quebec.

Winners are responsible for all taxes and fees payable to any government authorities because of winning a Prize.

10. Notification and Announcement of Winners

On or by October 23, 2012, using the contact information provided by Participants when they submitted their Entry, Concordia will make reasonable efforts to contact and notify the Winners. If Concordia is unable to contact a Winner through the above means or a Winner does not pick up their Prize by November 2, 2012, at 5 p.m. EST, such Winner forfeits his/her Prize and Concordia may, but is not required to, choose to award such Prize to the next runner up. No Winner may win more than one (1) Prize.

The public announcement of Winners will be posted on or before November 14, 2012, at 5 p.m. EST, in one or more of the following locations: on the Concordia website (www.concordia.ca), in the Concordia NOW news and events section (http://www.concordia.ca/now/), on the Student Hub landing page, on digital information screens around Concordia campus, on the official Concordia Facebook webpage (https://www.facebook.com/ConcordiaUniversity), on the official Concordia Twitter account (http://twitter.com/concordia) and/or on the official Concordia Flickr account (http://www.flickr.com/photos/concordiauniversity/), and on the official Concorida Pinterest page (http://pinterest.com/concordia).

11. Website abuses

Participants agree and undertake to not: (i) tamper with the entry process; (ii) act in an unsportsmanlike, disruptive manner; act in a manner that undermines the legitimate operation of the Contest; (iii) disparage, annoy, abuse, threaten or harass any other person on the Website; or (iv) submit incomplete, forged, software-generated or other automated multiple Entries.

12. Limitation of Liability and Obligation to Indemnify

The Participant agrees that Concordia is not responsible for failures and other issues with the Contest or Contest Website, including, but not limited to: (i) issues experienced downloading or uploading any contest-related information or Entries to or from the Contest Website or logging onto the Contest Website; (ii) any other technical malfunctions of electronic equipment, computer online systems, servers, internet providers, computer hardware or software; (iii) failure of any Entry to be received by Concordia due to, in whole or in part, technical problems, traffic, congestion, viruses or trojan horses on the internet or the Contest Website or any other reason; (iv) any damage to the Participant’s computer, hardware or software which may be caused, directly or indirectly, in whole or in part, due to that Participant’s participation in the Contest, the Participant’s use of the internet, the Contest Website or as a result of viruses or trojan horses contained thereupon; or (v) any other technical issues related to Entries, including telecommunication miscommunication or failure, and failed, lost, delayed, incomplete, garbled or misdirected communications which may limit an Entrant’s ability to participate in this Contest.

The Participant agrees to release and hold Concordia harmless for any indirect, special, incidental, consequential, punitive or loss of profits, copyright infringement, trademark infringement, regardless of the form of action, whether in contract or in tort including negligence (“Claims”), even if Concordia have been advised of the possibility of such damages.

If Concordia is made a party to any Claims commenced by or against the Participant in relation to the Contest or the Participant’s Entry or as a result of the Participant’s failure to respect the present Rules, then the Participant shall protect, indemnify and hold Concordia harmless and shall pay all costs and expenses and legal fees incurred or paid by Concordia in connection with such Claims. The Participant shall also pay all costs, expenses and legal fees that may be incurred or paid by Concordia in enforcing the terms, obligations and conditions of these Rules.

13. Disqualification

Failure to comply with these Rules may result in a Participant’s disqualification solely at Concordia’s discretion.

14. Governing Law and Disputes

These Rules shall be governed by and construed in accordance with the laws of the Province of Quebec and the laws of Canada applicable therein. The parties hereby irrevocably attorn to the exclusive jurisdiction of the courts of the Province of Quebec for any legal proceedings arising out of these Rules or the performance of the obligations hereunder.

Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.

15. Severability

If any provision, or portion thereof, of these Rules is determined by a court of competent jurisdiction to be invalid, illegal or unenforceable, such determination shall not impair or affect the validity, legality or enforceability of the remaining provisions of these Rules, and each provision, or portion thereof, is hereby declared to be separate, severable and distinct.

16. Number and Gender

Unless the context requires otherwise, words importing the singular include the plural and vice versa and words importing gender include all genders.
